Proposition 218 Public Notice

Special Rate Increase to Solid Waste Rates

These FAQs are provided to explain a proposed special rate increase to the City of Stockton’s solid waste rates for residential and commercial customers. A notice was directly mailed to each rate payer to provide information on the reasons for the proposed rate increase, and the process for opposing the proposed increase.

Public Hearing Notice (PDF)

The City Council may only consider adopting the proposed rate increases:

  • After the close of the public hearing; and,
  • If less than 50% of the rate payers protest the increase.

To allow for additional public comment, the public hearing will be held during two City Council meetings - April 15 and April 29, 2008.

If more than 50% of the affected rate payers protest the increase, it will be rejected. If less than 50% of the affected rate payers protest, the City Council will have the option to approve or reject the proposed special rate increase. If approved, the rate will become effective on June 1, 2008.

In 1996, California voters approved Proposition 218, "The Right to Vote on Taxes Act." Proposition 218 increased voter and taxpayer control over local government-imposed new or increased taxes, property assessments, and property-related fees. Proposed new or increased property-related charges such as solid waste charges require mailing of information to every affected ratepayer. In addition, a public hearing must be held at least 45 days after the mailing.

On February 27, 2008, the City Council approved mailing Proposition 218 notices and set an April 15, 2008 hearing date to consider a special residential rate increase of 2.5% and a special commercial rate increase of approximately 1%.

A Prop. 218 public hearing allows affected parties to state their approval or disapproval of certain rate increases.

In the case of the proposed special solid waste rate increases, only those affected parties who oppose the special increase need submit a protest. (See FAQ #5 for more details on how to submit a protest.)

Any rate payer (residential or commercial) subject to the proposed special solid waste rate increase may protest the increase by filing a written protest with the City Clerk at or before the close of the public hearing on April 15, 2008.

If a majority of customers submit written protests, the City Council could not consider the increases. If less than a majority of customers submit protest letters, the City Council could deny the increase or approve some or all of the proposed increase.

The City Council invites all rate payers to comment on the proposed rate increase. Rate payers’ comments must be submitted in writing, even if attending the public hearing on April 15, 2008.

There are FOUR ways to submit a protest letter regarding the special solid waste rate increase.

Regardless of which method you use to protest, the following information must be included:

  • The service address or assessor's parcel number (APN); and,
  • Name of the rate payer.

  4. In written format before the close of the public hearing.

    The public hearing will be held during the normally scheduled City Council meeting. The location of the City Council Chambers is 425 N. El Dorado St., 2nd Floor. The City Council meeting starts at 5:30 p.m.
