Opening Comments:

  • The Meeting was called to order by Mayor Edward Chavez at 3:45 p.m.
  • Mayor Chavez gave his welcome remarks.

OPEN DISCUSSION:

Mayor Chavez introduced Judge Bill Murray, District Attorney Jim Willett and Public Defender Jim Larsen.

Judge Bill Murray began by showing a PowerPoint presentation* that gave a detailed overview of crime and the court system.

Next, District Attorney Jim Willett gave a verbal presentation describing the duties of his office. 

District Attorney’s Office

  • Purpose of the office is to prosecute offenders
  • The mission of the office is not to receive a conviction but is to seek justice
  • Serves all courts in San Joaquin County
  • Administration
    • 1 District Attorney

  • Modes of prosecuting cases
    • Vertical – One lawyer and one prosecutor for all stages

Last, Public Defender Jim Larsen gave a verbal presentation describing the duties of his office. 

  • Administration
    • 54 Lawyers
  • Finances
    • Almost all funds come from taxes
    • Some funds are reimbursements from the State of California
    • Some funds are received by a charge assessed for services
  • Once arrested the court has 48 hours to file charges.  The Judge will decide whether or not the person can afford a lawyer.  A preliminary hearing is then set in 10 days.
  • Plea Bargaining is a process of negotiation, compromise and settlement.
    • 75-80% of felony cases are resolved by the time of the preliminary hearing.  Civil cases are not dramatically different.
    • Cases usually settled within 3 weeks of arrest usually consist of County Jail time – not prison. 
  • Cases are assigned not chosen.
  • We need to focus on intervention. 
    • Offenders need education, information and tools to change their behavior.
    • While incarcerated offenders should be offered training for anger management, pre-employment, drug/alcohol treatment, etc.
    • Good example is Beyond Incarceration where people are recruited from different services to educate the individuals at the honor farm.
      • Over the past year 312 inmates attended program and only 5% were rearrested and put back into jail.

Questions/Comments

  • A question was asked about the truancy problem in this area.  The facts were not available as to the exact numbers; however, a comment was made that we need to work as a community to keep the children in school and educated.  This is a community problem not just a parent problem.
  • A comment was made that children should not be expelled from school.  They need to be nurtured.
  • A question was asked regarding why court dates always start late.  Judge Murray explained that the Judge is most likely reading up on the case but agreed that case management in needed.
  • A question was asked to Public Defender Jim Larsen regarding who he knows that his lawyers are doing a good job.  Jim explained that he reviews every felony case that is closed.

Mayor Chavez gave his closing remarks.  The Committee will meet on Dec. 14th and then will take a break until January, 2006.  The County Administrators office will be giving a presentation at the first meeting of next year.

The next Committee Meeting has been scheduled for December 14, 2005, at 3:30 p.m. at the Stewart Hazelton Room of the Cesar Chavez Library located at 605 N. El Dorado Street, Stockton.  The committee will hear presentations from the City of Stockton Police Department; Gang Violence Suppression Unit.
