PARKING METERS — MISCELLANEOUS
PARKING REGULATIONS

Part I
PARKING METERS (Meter Hoods)


SEC. 11-001. DEFINITIONS:

1. Whenever any term is defined herein it shall be deemed and construed to have the meaning ascribed to it herein.

2. The definition of any term used herein not otherwise herein defined shall be the same as such term is defined and described in the Vehicle Code of the State of California and amendments thereto.

3. The word "vehicle" as used herein shall mean any device in, upon or by which any person or property may be transported upon a street or highway, except those operated upon rails or tracks.

4. The word "park" or "parking," when used herein, shall mean the standing of a vehicle, whether occupied or not, otherwise than temporarily, for the purpose of and while actually engaged in loading or unloading passengers or merchandise.

SEC. 11-002. INSTALLATION OF PARKING METERS:

The City Manager of the City of Stockton is hereby authorized to install, maintain and remove meters in parking meter zones hereby established or hereafter created by the Council of the City of Stockton, for the purpose of and in such numbers and at such places as may be necessary to the regulation, control and inspection of the parking of vehicles therein and in accordance with the provisions of Section 11-005 hereof.

SEC. 11-003. METHOD OF MARKING METER ZONES:

The City Manager shall have lines or markings painted or placed upon the curbs, streets, or municipal off-street parking lots adjacent to each parking meter designating the parking space for which said meter is to be used, and each vehicle parked adjacent or next to any parking meter shall park within the lines or markings so established. No person shall park any vehicle across any such line or markings or park a vehicle in such a position that the same shall not be entirely within the space designated by such lines or markings.

SEC. 11-004. PARKING METER ZONES:

All streets, any portion thereof, and all public off-street parking lots within any area described as a parking meter zone commencing with Section 11-004.1 and regulated by parking meters pursuant to Section 11-031.

SEC. 11-004.1. PARKING METER ZONE 1:

Parking Meter Zone 1 is bounded by the north line of Park Street from Madison Street to Aurora Street, the east line of Aurora Street from Park Street to Sonora Street, the south line of Sonora Street from Aurora Street to Madison Street, and the west line of Madison Street from Sonora Street to Lafayette Street, the north line of Lafayette Street from Madison Street to Lincoln Street, the west line of Lincoln Street from Lafayette Street to Weber Avenue, the south line of Weber Avenue from Lincoln Street to a point 516 feet west of Lincoln Street, from said point to the Stockton Channel, Stockton Channel from 516 feet west of Lincoln Street to Madison Street, the west line of Madison Street from Stockton Channel to Park Street and includes all the area within said boundaries.

SEC. 11-004.2. RESERVED:

SEC. 11-004.3. PARKING METER ZONE 3:

Parking Meter Zone 3 is bounded by the east and west lines of Wilson Way between the south line of Channel Street and the north line of Market Street and includes all the area within said boundaries.

SEC. 11-005. DETERMINATION OF MAXIMUM PARKING TIME LIMITS IN PARKING METER

ZONES; FILING WITH CITY CLERK:

The City Manager is authorized to determine according to the provisions hereinafter set forth in this Section the maximum parking time to be allowed in various parts of such Parking Meter Zones which have or will hereafter be designated by the City Council, and he shall cause appropriate signs to be installed within the public off-street parking lots and spaced at reasonable distances along the street curb, advising the public of the parking limitations.

In fixing the maximum time allowed for parking vehicles in the respective designated spaces adjacent to parking meters within the Parking Meter Zones, said designated locations for parking spaces have been, and the selection, changing or abandonment of such parking spaces and maximum parking time therein by the City Manager shall hereafter be, guided and governed by the location thereof, amount of traffic along side thereof, the demand for parking space adjacent thereto, the congestion of traffic thereat, the use of the streets on which said parking spaces are situated, the position thereof with respect to business congestion and all other traffic congestion existing.

Upon selecting, changing or abandoning such parking spaces and maximum parking times, the City Manager shall cause to be filed a record of such selections, changes, or abandonments with the Traffic Engineer, who shall keep a record of such selections, changes or abandonment so as to indicate at all times the parking meter locations and the maximum parking time permitted.

SEC. 11-006. LIMITED PARKING ZONES — OVERTIME PARKING SEPARATE VIOLATIONS:

Where a maximum parking time is indicated by sign or signs attached to parking meters, the leaving of a vehicle in a parking space so restricted for a period in excess of such maximum time shall be a separate and punishable violation for each and every maximum time period or portion of said maximum time period which the vehicle is left in the said parking space in excess of the initial period.

SEC. 11-007. MARKING ON VEHICLE TIRES — REMOVAL PROHIBITED:

In the event that a police officer or Parking Violation Deputy places on or under the tire of a vehicle a chalk mark or other identifying mark or object for the purpose of identifying the vehicle and its time of parking, no person shall erase or remove said chalk mark or identifying mark or object except by moving the vehicle to an entirely different parking stall.

SEC. 11-010. LIMITED PARKING OUTSIDE THE PARKING METER ZONE:

When signs are placed, giving notice thereof, no person shall stop, stand or park any vehicle outside the Parking Meter Zone between the hours of 8:00 a.m. and 6:00 p.m. of any day except Sundays and holidays, for a period of time longer than specified on such sign authorized by the City Manager pursuant to Section 10-002.3.

SEC. 11-012. USE OF COINS IN PARKING METERS:

Parking meters, when equipped to accept United States coins in denominations indicated, shall be so adjusted to show legal parking during said periods and at such rates as may be established, from time to time, by resolution of the City Council.

SEC. 11-013. COINS TO BE DEPOSITED BY OPERATOR OF MOTOR VEHICLE:

When any vehicle shall be parked in any space alongside of or next to which a parking meter is located in accordance with the provisions set forth herein, the operator of said vehicle upon so parking shall, and it shall be a violation to fail to, deposit immediately one (1) or more five cent ($.05), ten cent ($.10), or twenty-five cent ($.25) coins of the United States in such parking meter and then turn the operating key of said meter in a clockwise direction, after the deposit of each coin, to the extent allowed by the proper operation of the meter.

SEC. 11-014. USE OF SLUGS IN LIEU OF COINS — PROHIBITED:

No person shall deposit or cause to be deposited in any parking meter, any slug, device, or metallic substitute for five cent ($.05), ten cent ($10), or twenty-five cent ($.25) coin of the United States.

SEC. 11-015. USE OF FUNDS FROM PARKING METERS:

The coins deposited in parking meters as provided herein are hereby levied and assessed as fees to provide for the proper regulation and control of traffic for alleviation of traffic problems upon the public streets, for the creation of off-street parking and for studies relating to provisions for off-street parking. The funds created shall be devoted exclusively to these provisions.

SEC. 11-016. DAMAGE TO OR DESTRUCTION OF PARKING METERS:

It shall be unlawful for any person to deface, injure, tamper with, open or wilfully break, destroy or impair the usefulness of any parking meter installed pursuant hereto.

SEC. 11-017. PROHIBITED PARKING:

No person shall cause, allow, permit, or suffer any vehicle registered in his or her name or operated or controlled by him or her to be parked any day in any marked parking space upon any street or in any public off-street parking lot within the parking meter zone established as set forth herein, adjacent to a parking meter at any time during which such meter is displaying a signal indicating that the space is improperly in use, except during the time necessary to set said meter to show proper parking, from 9:00 a.m. to 6:00 p.m., except as follows:

1. Saturdays in Parking Meter Zone 1 only as defined in Section 11-004.1 of the Stockton Municipal Code; i.e., area bounded by north line of Park Street, east line of Aurora Street, south line of Sonora Street and west line of Madison Street.

2. Sundays; and the following holidays:

Washington's Birthday

Last Monday in May

July 4

First Monday in September Columbus Day

Veteran's Day

Thanksgiving Day

December 25

SEC. 11-018. CITATIONS:

Upon discovering or observing any violation of this Chapter, the enforcement officer, as authorized pursuant to Section 10-003.1 of this Code, is empowered to issue an administrative citation as provided in Sections 1-043 and 1-044; notices to appear, or citations in the usual form and manner as provided in the Vehicle Code of the State of California.

SEC. 11-019. CIVIL PENALTY:

In the event any person is issued an administrative citation pursuant to Section 11-018, such person shall be assessed a civil penalty in accordance with Sections 1-042 through 1-046 of this Code.

SEC. 11-020. SUPPLEMENTARY TO TRAFFIC REGULATIONS (Chapter 10 of this Code):

These provisions, so far as consistent therewith, shall be deemed to be in addition and supplementary to, and not in conflict with nor a repeal of prior or existing ordinances of this City, but shall be additional provisions for the regulation of traffic and parking in the Parking Meter Zone provided for herein.
