SEC. 9-600. TITLE:
This Division may be referred to as the Stockton Special Tax Financing Procedure Code.
SEC. 9-601. PURPOSE AND INTENT:
The purpose and intent of this Division is to establish a procedure for financing certain public capital facilities and public services through the establishment of community facilities districts and the levy of special taxes.
SEC. 9-602. SPECIAL TAX PROCEEDINGS:
Proceedings for the formation of a community facilities district or districts may be conducted pursuant to this Division whether or not provided in any general law.
SEC. 9-603. ALTERNATIVE PROCEDURES:
The procedures provided in this Division are alternative.
SEC. 9-604. NON-EXCLUSIVITY:
This Division is not exclusive. The resolution of intention in any proceedings under an act or general law may provide that such act or general law is supplemented by a part or parts of this Division.
SEC. 9-605. CONSTRUCTION:
This Division is to be liberally construed.
SEC. 9-606. INCORPORATION OF THE MELLO-ROOS COMMUNITY FACILITIES ACT OF 1982:
The Mello-Roos Community Facilities Act of 1982 (being chapter 2.5, commencing with Section 53311, of Part 1 of Division 2 of Title 5 of the Government Code, as amended from time to time (the "Act")), is incorporated in and made a part of this Division. Except as otherwise provided by this Division or Chapter, the mode and manner for making improvements and for levying and collecting special taxes shall be as prescribed in the Mello-Roos Community Facilities Act of 1982.
