SEC. 9-021. PERMIT:
It shall be unlawful for any person, firm or corporation to make any excavation in any public street, alley or other public place in the City of Stockton without first obtaining a permit issued by the Director of Public Works.
SEC. 9-022. NOTICE OF INTENTION TO EXCAVATE:
The person, firm or corporation intending to make any such excavation shall file with the Director of Public Works a written notice of such intention, describing specifically the location and area of the excavation or excavations intended to be made.
SEC. 9-023. REFILLING EXCAVATION:
The permittee shall refill and compact all excavations with materials prescribed by the Director of Public Works and according to standards and specifications established from time to time by said Director.
SEC. 9-024. ERECTION OF BARRIERS, ETC.:
It shall be the duty of every person, firm or corporation by whom or under whose immediate direction or authority, either as principal, contractor or employer, any portion of any public street, alley or other public place may be made dangerous by any excavation on such street, alley or other public place, to erect and so long as the danger may continue, and maintain around the portion of such street, alley or other public place, so made dangerous by such excavation, a good and substantial barrier and from sunset of each day to sunrise of the next day until such excavation is entirely refilled to place and maintain lights at each end of said barrier at a distance of not more than fifty (50) feet apart along the line thereof or at such distance as may be prescribed by the City Manager or his authorized representative.
SEC. 9-025. TIME FOR COMPLETION OF WORK:
After such excavation is commenced the work of making and refilling the same shall be prosecuted with due diligence, and so as not to obstruct the street, alley or other public place or the travel thereon more than is actually necessary therefor. If the work is not so prosecuted, or if the work of refilling does not, in the judgment of the Director of Public Works, comply with the terms hereof, the Director of Public Works shall notify the person, firm or corporation named in the permit that the work is not being prosecuted with due diligence, or that the refilling of such excavation has not been properly done, and require such person, firm or corporation, within five (5) days after the service of such notice, to proceed with the diligent prosecution of said work so as to properly complete the same without further delay. Such notice shall be written or printed and shall be personally served or served by leaving it at the residence or place of business of such person, firm or corporation, or if such person, firm or corporation cannot be found, and such place of business or place of residence is unknown or is outside of the City, said notice may be served by depositing it in the United States post office, postage prepaid, addressed to the person, firm or corporation at such place of business or residence, if known, or if unknown, at the City of Stockton. If such notice is not complied with the Director of Public Works shall cause such work to be done and the cost thereof shall be paid by the permittee.
SEC. 9-026. SUPERVISION AND INSPECTION OF EXCAVATIONS AND REFILLING:
All excavations and refilling of excavations made or done under the provisions set forth herein shall be made or done under the supervision and direction of the Director of Public Works or his authorized representative, whose duty it shall be to supervise and direct the making and refilling of all such excavations and to approve the same upon completion thereof.
SEC. 9-027. GAS OR WATER PIPES AND MAINS, SEWERS, ETC.:
It shall be unlawful and a misdemeanor for any person, firm or corporation to lay any gas or water surface pipe or main pipe, or private sewer, or any drain or other conduit in any street or other public place in the City of Stockton, at a distance of less than two (2) feet below the established grade of gutter of such street or alley, or less than two (2) feet below the surface of such other public place.
SEC. 9-028. FEES:
The person, firm or corporation making or causing to be made any excavation in a public street, alley or other public place in the City of Stockton shall pay to the City of Stockton such permit fee and costs for inspection, resurfacing, maintenance and permanent damage to paved sections as may be fixed or established from time to time by resolution of the City Council.

SEC. 9-029. TRENCH CUTS.
Any person, corporation, agency or entity, including any Department of the City of Stockton, or any other governmental agency or authority that is required to obtain a permit to excavate to do work in the public streets or alleys under Municipal Code sections 9-021 through 9-037 shall pay a trench cut fee. The trench cut fee is in addition to any other fee required by the City and is in addition to any backfill, compaction and pavement replacement or other requirements imposed by the Stockton Municipal Code or by the Department of Public Works as a condition of a permit.
It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this Section. Penalties for violation of this Section shall be as prescribed by this Code.

The person, firm or corporation making or causing to be made any trench cut in a public street, alley, or other public place in the City of Stockton shall pay to the City of Stockton such permit fee and costs for inspection, resurfacing, maintenance and permanent damage to paved sections as may be fixed or established from time to time by resolution of the City Council.
