SEC. 5-170. WORDS AND PHRASES DEFINED:
For the purpose of this Part certain terms, phrases, words and their derivatives shall be construed as specified in this section.
1. Public Library: Any building or structure or portion thereof, or any vehicle operated by or under the jurisdiction of the City of Stockton and used for library purposes.
2. Community Center: Any building or structure, or portion thereof, operated by or under the jurisdiction of the City of Stockton or the Metropolitan Park and Recreation Commission and used for a planned recreation program.
3. Recreation Facility: Any building or structure, or portion thereof, operated by or under the jurisdiction of the City of Stockton or the Metropolitan Park and Recreation Commission and used for recreation purposes.
4. School Property: Any building, structure or property, or portion thereof, operated by or under the jurisdiction of the Stockton Unified School District and used for education or recreation purposes.
SEC. 5-171. APPLICATION:
The provisions of this Part shall govern the conduct of all persons who use, frequent, loiter about or participate in the program of any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
SEC. 5-172. SMOKING PROHIBITED:
Whenever "No Smoking" signs or placards are posted in or about any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District, it shall be unlawful for any person to smoke or carry any lighted cigar, cigarette, pipe or match or use any spark, flame or fire-producing device within any such posted area.
SEC. 5-173. NOISE PROHIBITED:
It shall be unlawful for any person to make, continue, or cause to be made or continued any loud, unnecessary or unusual noise or any noise which annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others in or about any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
SEC. 5-173.1. TYPES OF NOISES PROHIBITED:
The following acts, among others are declared to be loud, unnecessary and disturbing noises in violation of Section 5-173, but said enumeration shall not be deemed to be exclusive, namely:
(1) Radios, Phonographs, etc.: The playing, using, operating or permitting to be played, used or operated any radio receiving set, musical instrument, phonograph, or other machine or device for the producing or reproducing of any sound, except when played, used or operated by or under the direction of an employee or representative of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
(2) Yelling Shouting, etc.: Yelling, shouting, hooting, whistling, loud talking or singing, except when done under the direction of an employee or representative of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
(3) Excessive Noise: The creation of any excessive noise adjacent to any public library, community center, recreation facility or school property while the same is in use.
SEC. 5-174. RIOTOUS, THREATENING, INDECENT, ABUSIVE, PROFANE, AND INDECENT CONDUCT OR LANGUAGE PROHIBITED:
It shall be unlawful for any person to indulge in riotous, threatening or indecent conduct or abusive, threatening, profane or indecent language in or about any public library, community center, recreation facility or school property operated by, or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
SEC. 5-175. CUTTING, DEFACING, BREAKING OR INJURING ANY BUILDING, STRUCTURE, OR EQUIPMENT PROHIBITED:
It shall be unlawful for any person to maliciously cut, deface, break or injure any building, structure, furniture or equipment in or about any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
SEC. 5-176. LOITERING PROHIBITED:
It shall be unlawful for any person to loiter, lounge, run or stroll in or about any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District except when said person is given permission to do so by an employee or representative of said city, commission or school district while said person is using the facilities of, or is participating in, a planned program at any such public library, community center, recreation facility or school property.
SEC. 5-177. EXPLOSIVES PROHIBITED:
It shall be unlawful for any person to explode or cause to be exploded any device which produces a loud or unusual noise or produces a foul or offensive odor in any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
SEC. 5-178. GIVING FALSE NAME OR ADDRESS, ETC., PROHIBITED:
It shall be unlawful for any person to give a name, address or telephone number, other than his own lawful name, address or telephone number, for the purpose of using, participating in the program of, or checking out or receiving any library material, athletic equipment or other material or equipment from any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District.
SEC. 5-179. EATING PROHIBITED:
It shall be unlawful for any person to eat or drink any food or beverage in any public library, community center, recreation facility or school property operated by or under the jurisdiction of the City of Stockton, the Metropolitan Park and Recreation Commission or the Stockton Unified School District except when said person is given permission to do so by an employee or representative of said City, commission or school district while said person is using the facilities of, or is participating in, a planned program at any such public library, community center, recreation facility or school property.
