LICENSE TO SELL FIREARMS


SEC. 4-045. SALE OF CONCEALED FIREARMS:

It shall be unlawful to sell pistols, revolvers, or other firearms capable of being concealed upon the person, at retail, within the City of Stockton, without a license issued in the manner herein provided for.

SEC. 4-046. LICENSE TO SELL:

The City Manager is hereby authorized to issue licenses to sell, at retail, within the City of Stockton, pistols, revolvers, and other firearms capable of being concealed upon the person. Such licenses shall be issued in the form prescribed by the Attorney General and shall be effective for not more than one (1) year from date of issue.

SEC. 4-046.1. LICENSE — CHIEF OF POLICE TO APPROVE:

The said licenses shall be issued only after a report in writing concerning said prospective licensee has been made by the Chief of Police to the City Manager. Said licenses shall not be issued to any person who
(a) has been convicted of a felony and has served a term of imprisonment therefor in a State or Federal prison.
(b) has been convicted of any violation of the Dangerous Weapons Control Law of the State of California, or
(c) is not of good moral character.

SEC. 4-046.2. LICENSE — REVOCATION:

Any of the reasons which would prevent the original issuance of said license shall also make the revocation of said license mandatory by the City Manager.

*Editor's Note: Part II, Division 5 of Chapter 4 (Possession or Sale of Assault Weapons Prohibited) previously added by Urgency Ordinance 007-89C.S. — Effective February 6, 1989; was repealed in its entirety by Ordinance 024-97C.S. — Effective October 2, 1997.

SEC. 4-047 “SAFE AND SANE FIREWORKS,” DEFINED.
“Safe and Sane Fireworks” refers to and shall have the same meaning as set forth in California Health and Safety Code sections 12529 and 12562, and the California Code of Regulations, Title 19, Article 6, or as those provisions are subsequently amended.

SEC. 4-047.1 SAFE AND SANE FIREWORKS PROHIBITED.
It is unlawful for any person to possess, sell, offer for sale, use or discharge any safe and sane fireworks within the limits of the City of Stockton. Violation of this section shall constitute a misdemeanor.

SEC. 4-047.2 SEIZURE AND DESTRUCTION OF FIREWORKS.
Safe and sane fireworks within the limits of the City of Stockton are subject to confiscation by the Stockton Police Department and the Stockton Fire Department. Confiscated fireworks shall be destroyed at the expense of any person found in violation of section 4-047.1, after conviction, plea of guilty or nolo contendere, or posting and forfeiting of bail.
