RESERVE POLICE CORPS


SEC. 4-060.1. CREATION:

The Stockton Police Reserve is hereby created. It shall have a complement of not more than one hundred twenty five (125) officers who shall be appointed by the City Manager and shall be under the direction of the Chief of Police.

SEC. 4-060.2.

SEC. 4-061. DEFINITIONS:

Whenever herein the following terms are used, they shall have the meaning ascribed to them in this Section, unless otherwise apparent from the context. 1. CITY MANAGER means City Manager of the City of Stockton.
2. CHIEF shall mean Chief of Police.
3. RESERVE shall mean the Stockton Police Reserve.
4. MEMBER shall mean member of the Stockton Police Reserve.

SEC. 4-062. MEMBERSHIP ELIGIBILITY REQUIREMENTS:

To be eligible to membership in said Reserve, each applicant must indicate his willingness to serve an average minimum of eight (8) hours per month in the public service, and where any member has failed to give said minimum hours of service for a period of two (2) months the Chief shall inquire into the reasons therefor and unless good reason is shown for said failure to render the minimum hours herein required, the Chief may recommend to the City Manager the dismissal of the member from said Reserve.

SEC. 4-063. QUALIFICATIONS AND APPOINTMENT TO MEMBERSHIP:

The Chief of Police shall, by rule, prescribe the qualifications and standards by which applicants for membership in said Reserve shall be governed and persons possessing said qualifications and conforming to said standard, may be appointed to said Reserve by the City Manager.

SEC. 4-064. DUTIES OF MEMBERS:

Members shall perform only such public service as may be ordered by the Chief and it shall be unlawful for any person to willfully resist, delay or obstruct any member in the discharge, or the attempt to discharge, of any duties of his office.

SEC. 4-065. DUTIES OF MEMBERS — ADDITIONAL:

In addition to the duties assigned by the Chief, the Reserve is hereby assigned the duty of preparing against the perils of civilian life and property that may be expected to result from attack from or during war or from any disaster that may threaten lives and property in the City of Stockton.

SEC. 4-066. POWERS OF MEMBERS — PEACE OFFICERS:

In the enforcement of the penal laws of the State of California, or the penal ordinances of the City of Stockton, and in the performance of such other duties as may be designated by the Chief, every duly authorized member shall be deemed to have all the powers of a peace officer.

SEC. 4-067. DISABILITY AND HOSPITAL BENEFITS FOR MEMBERS:

Members suffering injury arising out of and in the course of duties assigned to them by the Chief, are entitled to such medical care, hospitalization and other benefits as the City of Stockton, may, by ordinance, provide, or to such benefits as said members shall be entitled to under the Labor Code of the State of California.

SEC. 4-068. UNIFORM, EQUIPMENT AND BADGE TO BE PRESCRIBED BY CHIEF OF POLICE:

The uniform, badge and equipment, to be worn and carried by the members, shall be prescribed by the Chief.

SEC. 4-069. UNIFORM, EQUIPMENT AND BADGE MAY BE SUPPLIED BY CITY:

The City is hereby authorized to purchase the uniform, badge and equipment of the member, out of public funds, upon recommendation of the City Manager. Uniform, badge and other equipment shall be returned to the Chief upon separation of any person from said Reserve.

SEC. 4-070. MEMBERS SERVE WITHOUT COMPENSATION — EXCEPTIONS:

No member shall receive any compensation from the City for any service rendered, but in event of injury or death to a member while he is discharging duties assigned to him by the Chief, said member or his beneficiaries shall be entitled to benefits provided by the Labor Code of the State of California.

SEC. 4-071. DISMISSAL OR RESIGNATION OF MEMBERS:

The City Manager, upon recommendation of the Chief, may dismiss a member from the Reserve, without any hearing whatsoever, and each member shall have the right to resign from said Reserve at any time.

SEC. 4-072. MEMBERS DEEMED TO BE PUBLIC OFFICERS:

All persons appointed by the City Manager, pursuant to the provisions set forth herein, shall be deemed to be public officers.

SEC. 4-073. RULES AND REGULATIONS FOR GOVERNMENT OF CORPS TO BE PROMULGATED BY CHIEF OF POLICE:

The Chief is hereby authorized, directed and empowered to prepare and promulgate such rules and regulations and revisions, and amendments thereof, as may be, in his discretion, necessary to carry out the express intent set forth herein.

SEC. 4-074. FALSE IMPERSONATION — UNLAWFUL:

It shall be unlawful for any person to falsely impersonate or represent himself to be a member, or to wear, use, or possess, a badge used by the Reserve.
