MISCELLANEOUS ADMINISTRATIVE PROVISIONS

STOCKTON FIRE DEPARTMENT
(Confirming its establishment and defining its organization, powers and duties)
SEC. 3-020. ORGANIZATION:
The Fire Department shall be organized, pursuant to the provisions of the Charter
of the City of Stockton. Operating units shall be established by the Fire
Chief with the consent of the City Manager.
SEC. 3-020.1. DUTIES:
The duties of the Fire Department shall be:
1. To extinguish all uncontrolled fires within the limits of the City of Stockton.
2. To extinguish uncontrolled fires outside the City limits of the City of
Stockton, as authorized by the City Manager.
3. To inspect and keep in serviceable condition all assigned apparatus, equipment
and facilities.
4. To develop all proper means of fire prevention and fire protection.
5. To enforce the provisions of a Fire Prevention Code and other ordinances
of the City of Stockton, or laws of the State of California, the enforcement
of which is the specific responsibility of the Fire Department.
6. To report any violations of laws, ordinances, codes and regulations to the
public officials responsible for their enforcement.
7. To investigate the cause of all fires.
8. To report to the proper authorities all fires resulting from or accompanied
by the commission of a crime, and to render all assistance possible in the
prosecution of those committing such crimes.
9. To assist and relieve persons or animals in distress or danger, to aid in
the protection of property from loss by accident; to maintain and operate emergency
vehicles, as defined by the California Vehicle Code, for such purposes.
10. To maintain in proper form a complete record of all activities and operations
of the Fire Department. Such records need not, however, be kept longer than
five years.
SEC. 3-020.2. POWERS OF THE FIRE CHIEF:
The Fire Chief shall be the Chief Executive Officer of the Fire Department,
and subject to the approval of the City Manager, shall have control, management
and direction of all members, bureaus and divisions within said department,
and all buildings, apparatus and equipment used in connection therewith.
1. The Fire Chief, or his deputies, may immediately abate any menace, with
respect to fire safety, which forms a clear and present danger to the life
of any person or persons.
